Terms and Conditions

Please read the following terms and conditions carefully.

In the following terms & conditions “we", "our" and "us" shall refer to Future Proof Photography Ltd. These terms & conditions cannot be varied in any way by the clients unless such terms are expressly agreed in writing.

SHOOTS
For all shoots except subscription shoots, the client agrees to supply products and populate a brief within an agreed time period and no later than 7 days to allow for the sourcing of any props and ingredients that might be required for a shoot. If the product does not arrive 4 days before the shoot or a brief has not been completed within the required time period, the shoot may be delayed or cancelled by us and the client will be subject to last minute postponement or cancellation charges, as stated below.

For subscription shoots, the client agrees to supply the products and populate a brief at the start of the subscription month or by the end of the first working week of each month. We will deliver the content specified in the subscription package selected by the client at the end of each month, or the month of choice if the client has selected a bi-monthly or quarterly subscription. If the product does not arrive, or the brief has not been completed within the required time period, the shoot may be delayed or cancelled by us and the client will be subject to last minute postponement or cancellation charges, as stated below.

Our subscription packages run on 3, 6 and 12 month contracts.

CANCELLATION & POSTPONEMENTS ​
Please note that postponements and date movements are also part of this cancellation policy and can incur additional fees as stated below.

Once the Client has made a booking for a specific time and date, Future Proof Creative will not accept any other work from other clients for those times and dates. As a result, once a booking is made, if it is subsequently cancelled or postponed by the client, a fee will be charged to the client according to the following schedule. When a client cancels or postpones a booking:​

with a minimum of 2 weeks notice of any confirmed date, a fee of 0% will be charged;
-
within two weeks notice of any confirmed date, a fee of 50% of the total booked time rate will be charged and payable; or,
-
within one weeks notice of any confirmed date, a fee of 100% of the total booked time rate will be charged and payable.

Any expenses incurred by us in preparation for the shoot will be charged to the client and payable.
​
These fees will be payable within 14 days post the shoot date.​​​

THE BRIEF ​
​

The client is solely responsible for populating a brief that is clear, contains all necessary information and is adequately detailed with any relevant references or other information.

The brief must be agreed by us.

We will work exclusively from the agreed brief and complete the shoot to include only what is described in the brief.

Once the brief is agreed by us, any information which is not included in the agreed brief and that the client communicates a wish to be included in the shoot, must be first agreed by us and then added to the brief by the client.

In the event that a reshoot is required due to an unclear or inaccurate brief, an additional cost will be charged to the client according to the costs outlined in the post production and editing clause below.

PROPS, PRODUCTS AND FOOD

For studio shoots, we have a well equipped studio with a variety of props, but if a project requires props we do not have, we will ask the client to source and send them along with their product, or arrange for them to be sent to the studio address.

Shoots requiring simple food props will be sourced locally and invoiced back to the client but for more complex setups requiring larger quantities of food, out of season ingredients or complex recipe prep, we will ask the client to arrange for delivery of items to the studio.

For all other shoots, all props are to be agreed prior to the shoot and expensed to the client.

​Any props or products supplied by the client can be stored at our studio for a period of no more than 6 months. After this 6 month period expires, any props or products not collected by the client will be disposed of, unless otherwise agreed in writing.

DELIVERY
​
We will deliver the digital files via Dropbox within 7 days from the date of the shoot, providing full payment has been received, unless otherwise agreed in writing.​
​

PAYMENT SCHEDULE
Failure to make full payment for the shoot within 14 days from the final day of the date of the shoot will result in a late payment fee plus statutory interest (8% plus current Bank of England base rate) on the total fee payable for the shoot:
​
- Extra £40 fee to be added for the total fee payable equal to less than £1000 (plus statutory interest)
- Extra £70 fee to be added for the total fee payable equal to £1000 - £10,000 (plus statutory interest)
- Extra £100 fee to be added for the total fee payable equal to more than £10,000 (plus statutory interest)

​If payment for the total fee payable including late payment fee has not been made within 7 days of receiving a notice, further action will be taken.

CONTENT USAGE & LICENSING TERMS
Unless otherwise agreed in writing, all content we produce remains our copyright and/or intellectual property. We grant you a non-exclusive commercial usage license. This allows you to use the content globally, across any business-related platforms, with no expiration.​​​
​
For the avoidance of doubt, this does not affect any copyright or intellectual property owned by models.
​
DISPLAY
The client gives permission to Future Proof Photography Ltd to display any creative content covered by this contract for promotional purposes unless agreed otherwise in writing.
​
​
POST PRODUCTION AND EDITING
Basic edits and retouching are included in our prices but please be aware that items will be shot in the condition we receive them. If we receive a product or its packaging in a damaged condition and it requires retouching this will be at an additional cost of our hourly rate.
Client requests for basic edits and retouching can be made:

up to one month post-shoot at no additional fee; and,
-
after one month post-shoot at an additional fee charged at our hourly rate.
For the avoidant of doubt, this does not include edits required due to us receiving a defective or damaged product as described above, or for any edits which go beyond lighting and colour correction of one revision or simple stop-motion and video editing.
REFUND PROVISIONS

In the event that we are unable to deliver content for any reason, we will offer to reschedule the shoot or, where this is not possible, issue a full refund to the client. ​​
