Subscription Package - Terms and Conditions

In the following terms & conditions “we" shall refer to Future Proof Creative. “The clients” shall be those persons defined on the form above. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed in writing.

THE AGREEMENT 

The client agrees to supply products and populate a brief to cover all content at the start of the subscription month or by the end of the first working week of each month. We will deliver the content specified in the subscription package selected by the client at the end of each month, or the month of choice if the client has selected a bi-monthly or quarterly subscription.

THE BRIEF 

We are happy to contribute our own creative ideas but the client is ultimately responsible for populating a working brief that is clear and contains all necessary information for the shoot. Without a brief we will be unable to do the shoot. Small details in email chains and conversations are easily missed so if you mention anything to us via email or phone please add it to the brief to ensure it will be factored in during the shoot. If a reshoot or edit is required due to information missing from the brief this will be at an additional cost. 

 

If you have a specific style or look in mind please make sure to include detailed instructions along with reference images and add them to the brief. Any reshoots due to a change of brief, an unclear brief or a change of mind on the client's part will be at an additional cost.

PROPS AND FOOD 

We have a well equipped studio with a variety of props, but if a project requires costly or specialist props we will ask the client to source and send them along with their product. Shoots requiring simple food props or flavour cues are included in the subscription package but more complex setups requiring larger quantities of food, out of season ingredients or complex recipe prep will be counted as an 'add on' to the subscription package. These will be quoted case by case and agreed between the client and Future Proof Creative prior to the shoot.

DELIVERY

Future Proof Creative will deliver digital files via Dropbox at the end of the month. If you need images delivered by a specific date please let us know and we will do our best to cater to your needs - if your content is especially time sensitive we recommend working one month in lieu to be safe (eg: content for Christmas should be listed in the November brief rather than December).

PAYMENT SCHEDULE 

Payment in full is to be made no later than 2 weeks after the content is delivered. Failure to pay will result in cancellation of the subscription package and further legal action.

COPYRIGHT & LICENSING AGREEMENT

We retain the ownership and copyright of all content we create. Clients will be granted a commercial license, meaning that you can use our images anywhere in the world for any business purpose with no expiration dates as long as you are not selling our images.

DISPLAY

The client gives permission to Future Proof Creative to display any creative content covered by this contract for promotional purposes unless agreed otherwise in writing.

POST PRODUCTION AND EDITING
Basic edits and retouching are included in the subscription package, but please be aware that the product will be shot in the condition we receive it. If we receive the product or its packaging in a damaged condition and it requires retouching this will be considered an extra cost. 

 

PHOTOSHOP AND ADVANCED RETOUCHING 

Major photoshop manipulations or advanced re-touching are considered as an 'add on' to your subscription. These will be quoted case by case and agreed between the client and Future Proof Creative in writing. In some cases we can potentially substitute content in the subscription package with a manipulation, (such substituting one setup for a manipulation).

LIABILITY LIMITATIONS 

In the event that we are unable to deliver content for any reason, such as injury, illness, acts of God or loss of digital files, we will offer a full refund or make up the content in the following shoot depending on the clients' preference.

CANCELLATION POLICY 

As our subscription packages run on 3, 6 and 12 month contracts. At the end of the contract you are free to renew or cancel your subscription.
